Building a CHRT that works for Canadians: Annual Report 2021

This is the Canadian Human Rights Tribunal's (CHRT) 2021 Annual Report, which evaluates the work completed by the Tribunal during 2021 in an ongoing effort to ensure Canadians are being given the most modern, accessible, and fair human rights adjudications.
During 2021, the Tribunal changed the process to allow a more streamlined and simpler approach to mediation, and the Tribunal also held a record number of mediations and hearing days.
With new mandates such as the Pay Equity Act and the Accessible Canada Act, the Tribunal has had to adjust to the unprecedented volume of cases.

Canadian Human Rights Tribunal

The Canadian Human Rights Tribunal is an independent body at an arm's-length of the government who hears cases of equality and discrimination violations within federally regulated institutions such as: the military, airlines, trucking companies, banks, and the federal government.
The decisions made by the Tribunal are independent from influences of any Minister or government official.
The Canadian Human Rights Commission passes on cases to the Tribunal to investigate and determine whether discrimination has taken place and how to move forward.
The Tribunal is a less formal version of a court of law in that in only hears cases relating to discrimination.

Canadian Human Rights Commission

The Canadian Human Rights Commission's mandate is to "protect and promote human rights, and to advance equality and inclusion in Canada."
The Commission works closely with federally regulated employers to help eliminate barriers to equality and discrimination in an institution that answers to the Federal government such as banks, trucking companies, First Nations governments, etc.
The Commission gives citizens information about their rights, they help protect people from discrimination and they act as a government body to address and resolve human rights issues/concerns.
The Commission conducts research, informs/advises Parliament, engages the public, raises awareness, and conducts mediation sessions on cases where an individual feels they have been treated unfairly based on race, disability, sex, marital status, religion, colour, national or ethnic origin, age, sexual orientation, family status, etc.
If the concern is outside of the Commission's abilities, they will refer the case to the Canadian human Rights Tribunal.
Anyone who feels they have been a victim to discrimination, can file a complaint to the Canadian Human Rights Commission.

Canadian Human Rights Act

The Canadian Human Rights Act, initially enacted in 1977 and later amended in 1985 (and current to 2022), ensures equality of opportunity and prohibits discrimination on the following grounds: race, national or ethnic origin, colour, religion, age, sex, sexual orientation, gender identity or expression, marital status, family status, genetic characteristics, disability, and conviction for an offence for which a pardon has been granted or in respect of which a record suspension has been ordered.
Through the Canadian Human Rights Act, two human rights bodies were created: the Canadian Human Rights Commission (found in Part II of the Act) and the Canadian Human Rights Tribunal (found in Part III 48.1).
Both bodies are able to make decisions that can be appealed to the Federal Court of Canada.
The Canadian Human Rights Act is different from the Charter of Rights and Freedoms is that it only covers equality rights rather than a broad range of rights.
The Act also only governs federal jurisdictions, which means it protects any person employed or who receive services from the federal government, First Nations governments or private companies that are federally regulated (ex. banks, truck companies, broadcasters, and telecommunication companies).
Every province/territory has its own human rights legislation that covers local institutions within the province or territory such as schools or hospitals.
The 1977 legislation prohibited discrimination on the basis of race, religion, national origin and included more progressive rights (at its time) including sex (including sexual harassment and pregnancy), ethnic origin, age, marital status, physical disability, and pardoned conviction.
Over the years, the Act has been amended to include protection of the right to sexual orientation (1996) and gender identity/expression (2017).
This act was, in many ways, the product of decades of human rights legal reform at the provincial level with many provinces quickly adopting their own human rights laws (largely based on the original Ontario model).
