Bill S-3
  • Bill S-3 was developed to address the sex-based inequities present within the Indian Act.
  • This Bill is commonly known in association with the Descheneaux Case, which comes from Stephane Descheneaux of the Abenaki community of Odanak who was unable to pass on the status to his daughters because his Indigenous grandmother married a non-Indigenous man.
  • If the gender was reversed, he would have been able to pass on the status, which sparked the Superior court of Quebec's decision in favour of Descheneaux and led to Bill S-3 (and the subsequent changes to the Indian Act).
  • This bill implemented several changes to the Indian Act and allowed for many descendants, who would have previously been unable to gain status due to the discriminatory measures, to finally obtain status.
